SilverBackWheels Terms and Conditions
1. Introduction
These Terms and Conditions govern the services provided by SilverBackWheels (“Company,” “we,” “us,” “our”) to its customers (“Client,” “you”). By using our services, you agree to comply with and be bound by these terms. These Terms and Conditions are in accordance with Portuguese law.
2. Services Provided
SilverBackWheels offers the following services:
– Vehicle sales assistance (advertising, negotiations, and paperwork handling)
– Vehicle sourcing (finding and inspecting cars, negotiating prices, and managing legal importation)
– Vehicle maintenance and detailing through a trusted network of third-party providers
– On-call assistance for minor vehicle issues
3. Service Fees
– Our vehicle sales service operates on a commission basis (5% of the final sale price, with a minimum fee of €250).
– For vehicle sourcing, a pre-agreed service fee applies depending on the level of service required.
– Any additional costs, such as third-party mechanical services or detailing, will be quoted and agreed upon before work begins.
– All fees are due upon completion of services unless otherwise agreed in writing.
4. Vehicle Sales and Purchase
– SilverBackWheels acts as a facilitator and is not responsible for the final transaction between buyers and sellers.
– We do not provide warranties on vehicles unless explicitly stated in writing.
– The Client is responsible for ensuring the accuracy of the information provided about the vehicle.
– If a Client withdraws their vehicle from sale after marketing has commenced, a €100 administration fee applies.
5. Vehicle Inspection and Importation
– Vehicles sourced through SilverBackWheels will undergo a basic inspection, but we do not provide guarantees or mechanical warranties unless agreed with a third-party service provider.
– All importation processes follow Portuguese legislation, including customs clearance and registration.
6. Payment Terms
– Payments for services must be made via bank transfer, Revolut, or other agreed methods.
– Late payments may incur a penalty in accordance with Portuguese law (Decreto-Lei n.º 62/2013).
7. Liability
– SilverBackWheels is not responsible for defects or issues with vehicles sold through our platform or third-party services.
– We do not accept liability for financial loss resulting from vehicle transactions or maintenance services.
– In case of disputes, Portuguese consumer protection laws (Decreto-Lei n.º 24/2014) apply.
8. Cancellations and Refunds
– Clients may cancel a service request before work has commenced without penalty.
– Refunds are not available for completed services unless otherwise required by law.
9. Privacy Policy
– SilverBackWheels collects and processes personal data in accordance with the General Data Protection Regulation (GDPR) and Portuguese data protection laws (Lei n.º 58/2019).
– Personal data will only be used for service provision and will not be shared with third parties without consent.
10. Governing Law and Jurisdiction
– These Terms and Conditions are governed by Portuguese law.
– Any disputes will be resolved in the courts of Faro, Portugal.
11. Amendments
SilverBackWheels reserves the right to modify these Terms and Conditions at any time. Clients will be notified of any changes before they take effect.
